1. About these terms
These terms govern your use of the Sightyness online vision screening service at sightyness.com. By using the service or purchasing a screening, you agree to them. If you do not agree, please do not use the service.
Your privacy is covered separately in our Privacy Policy, which forms part of these terms.
2. What Sightyness is — and is not
Sightyness is an automated vision screening tool. It presents standard chart-based tests through your device's screen and camera, and reports how you performed.
It is not:
- A medical diagnosis, or a substitute for one
- A comprehensive eye examination
- A prescription, or a basis for ordering glasses or contact lenses
- A way to detect eye disease
Screening cannot detect many serious eye conditions, including glaucoma, retinal disease, macular degeneration and cataracts. A normal Sightyness result does not mean your eyes are healthy. Only a qualified optometrist or ophthalmologist can assess that, and we recommend regular professional examinations regardless of your results here.
If you have symptoms — sudden vision changes, pain, flashes, floaters, or loss of vision — seek professional care promptly rather than relying on this or any screening tool.
3. Who may use the service
The service is intended for adults. A parent or legal guardian may complete a screening on behalf of a minor, and is responsible for the accuracy of the details provided and for acting on the results.
You are responsible for the accuracy of the information you enter. Results reported against incorrect details may be meaningless.
4. Accuracy and limitations
Results depend on conditions we cannot control or verify, including your screen size and brightness, room lighting, your distance from the screen, whether you are wearing your usual correction, and whether you follow the on-screen instructions.
The service estimates your viewing distance using your camera in order to size the test material. This estimate is approximate. Where conditions make an accurate test impossible — for example if you are too close to the screen — the service will tell you rather than produce a result.
We do not guarantee that results are accurate, complete, or comparable to a clinical examination.
5. Payment, pricing and tax
A free screening covering visual acuity is available. The complete screening — all four tests, detailed recommendations and a report — is charged at the price shown at checkout, per screening, as a one-time payment. It is not a subscription and does not renew.
Applicable sales tax is added at checkout based on your location. Payments are processed by Stripe; we do not store your card details. Prices are in Canadian dollars unless stated otherwise.
Each payment unlocks one screening. A further screening requires a further payment.
6. Refunds
If the service fails to deliver the screening you paid for — for example a technical fault prevents you completing the tests, or your report is not produced — contact us and we will refund you in full.
Because the screening is delivered immediately and its value is in the result itself, we do not generally refund completed screenings on the basis that you did not like the outcome. A result you disagree with is a reason to see an optometrist, not necessarily a fault in the service.
Refund requests should be sent to info@sightyness.com with the email address used at payment.
7. Acceptable use
You agree not to:
- Attempt to bypass payment, or access paid features you have not paid for
- Interfere with the service, its security, or other users
- Use automated means to submit results, or deliberately submit false information
- Resell or redistribute the service without a written agreement with us
We may suspend access where we reasonably believe these terms have been breached.
8. Clinic and corporate accounts
Clinics and organisations may screen their own patients or staff under a separate plan. Where they do, results are shared with that organisation, and their own privacy obligations to the individual apply alongside ours. Usage is counted against the plan, and the organisation is responsible for how the service is used under its account.
9. Intellectual property
The Sightyness name, logo, software, test content and reports remain our property. You may use and keep your own results and report. You may not copy, adapt or redistribute the service itself.
10. Limitation of liability
The service is provided on an "as is" basis. To the fullest extent permitted by law, we are not liable for any loss arising from reliance on screening results, including any decision to seek or delay professional eye care.
Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or your rights under applicable consumer protection law.
Where liability cannot be excluded, it is limited to the amount you paid for the screening in question.
11. Changes to the service or these terms
We may change or discontinue features, and may update these terms. The date at the top of this page shows when it was last revised. Continued use after a change means you accept the revised terms.
12. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes are subject to the courts of Ontario.
